Cannabis Industry Faces Major Recalls and Product Notices in New Mexico

On September 4, 2024, the Cannabis Control Division (CCD) issued a recall for Maggie’s Farms (WH Agriculture, LLC, BC Agriculture, LLC, SR Agriculture, LLC) after discovering that cannabis products tied to Parent ID #8839486308602637 tested positive for pyrethrins, a prohibited pesticide. The recall affects products that were distributed without proper Certificates of Analysis (COAs) to verify compliance with pesticide regulations.

Maggies Farm

Maggie’s Farms operates under three licenses, overseeing a combined 50,704 plants across multiple facilities:

  • BC Agriculture, LLC – 52 CR 2290, Aztec, with 17,968 plants.

  • SR Agriculture, LLC – 2105 Producer, with 7,909 plants.

  • WH Agriculture, LLC – CR 2290 Production, with 24,827 plants.

Due to the inability to provide documentation proving the products passed pesticide testing, Maggie’s Farms must remove and destroy all affected products. They are also required to notify licensees and submit a recall plan and inventory report to CCD Environmental Scientist Chris Romero within 48 hours.

Retail Stores Respond

The recall has impacted several dispensaries, including:

  • Loud Cloud, LLC – 4000 Menaul Ste 2522 B, Albuquerque, NM 87110

  • R. Greenleaf Organics Dispensary – Locations in Albuquerque, Alamogordo, Carlsbad, Sunland Park, Las Vegas, Belen, and Albuquerque’s Coors Blvd.

  • Everest Apothecary – 9241 4th St NW, Albuquerque, NM 87114

  • House of Blaze, LLC – 5005 Menaul Blvd NE, Albuquerque, NM 87110

Budder Pros

In addition to Maggie’s Farms, Budder Pros has issued a voluntary recall affecting multiple SKUs of products from several dispensaries. While the reason for this recall remains unclear, Budder Pros is taking precautionary steps to remove the affected products from the market, advising dispensaries to comply with the recall.

Budder Pros has also issued a notice regarding their edible products, including food, drinks, tinctures, and Buddha Tears, with production dates from February 7, 2024, onward. Due to delays in acquiring their Green Sticker certification, these products are currently void under CCD regulations. However, this is not a formal recall, and the products are considered safe for sale and consumption once certification is completed, expected within two weeks. Until then, all affected products must be quarantined in a 24/7 video-monitored area in compliance with CCD regulations.

These recalls and notices highlight the need for strict testing, certification, and regulatory compliance in the cannabis industry to ensure consumer safety. Both Maggie’s Farms and Budder Pros are taking necessary steps to address these issues, emphasizing their commitment to safety and regulatory standards.
